1. Introduction

  • Welcome to ServEase (“we”, “our”, “us”)! We’re glad to have you here, and we hope you find our platform useful and beneficial. ServEase provides a gateway for service providers to connect with local clientele.
  • By using ServEase, you agree to abide by these Terms of Service and any other terms we may provide in the future. If you do not agree with these terms, you must cease usage of ServEase immediately.
  • We reserve the right to remove or suspend your account if you do not abide by these terms.
  • 2. Account Registration

  • To access the features of ServEase, you must create a profile. It is imperative that you provide accurate and complete information when setting up your profile.
  • To use the Service, you must be at least 13 years of age. This acknowledges the legal age for consent to the processing of personal data under certain jurisdictions.
  • 3. Subscription Services

  • If you "Join as a Provider", you are required to purchase a subscription to access the provider features mentioned on our platform, including but not limited to creating a detailed profile, uploading photos, and managing appointments.
  • At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it.
  • 4. Fees

  • We reserve the right to change the price of the Subscription at any time. Any changes in price will be communicated to you at least 30 days in advance to provide you with an opportunity to terminate your Subscription before such changes come into effect.
  • Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.
  • 5. Refunds

  • The Application Store's refund policy will apply. If You wish to request a refund, You may do so by contacting the Application Store directly.
  • 6. Free Services

  • We offer free services if you "Join as a Customer". Free services allow you to browse, search, and interact with service providers on our platform.
  • 7. User Content

  • Users are responsible for the content they upload to ServEase, ensuring it complies with all applicable laws and does not infringe on the rights of any third party.
  • By posting Content to the Service, You grant Us the right and license to modify such Content on and through the application. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the application, who may also use Your Content subject to these Terms.
  • 8. Content Moderation and Objectionable Content

    Monitoring and Review for Safety

  • At ServEase, safety is a top priority. We employ a combination of human moderators and automated systems to monitor and review accounts and interactions on ServEase. This is to ensure compliance with our Terms and Conditions and to identify content that may be harmful or against our community standards.
  • Involvement in Safety

  • Our members play a critical role in maintaining the safety of ServEase. We encourage our community to report any content or behavior that may violate our Terms of Service. If you encounter anything that makes you feel uncomfortable or unsafe on ServEase, we strongly recommend using the Block or Report features available within the app.
  • Reporting

  • Please be mindful that disagreement or personal dislike is not a valid basis for reporting a member. Intentionally creating false reports or repeatedly making baseless reports of bad behavior against other members may result in action being taken against your account.
  • Enforcement Philosophy

  • Compliance with our platform rules, as outlined in our Terms of Service, is mandatory for all members. Violations of ServEase's Terms of Service, our values, or any behavior deemed potentially harmful to ServEase or its members, may lead to various corrective actions, including but not limited to:
    • Removing the content.
    • Issuing a warning to the offending member.
    • Deleting the member's account, or in some cases banning the member from ServEase.
    • Cooperation with law enforcement for potential criminal investigations related to member conduct.

    Appeal Process

  • If you believe an error has been made in moderating your account or content, you are welcome to contact us at support@servease.me for review.
  • Prohibited Content

  • We define and prohibit objectionable content on ServEase to ensure a respectful and safe environment. Such content includes, but is not limited to:
    • Defamatory, discriminatory, or mean-spirited content.
    • Content that depicts violence or abuse in a realistic manner.
    • Encouragement of illegal or reckless use of weapons.
    • Overtly sexual or pornographic material.
    • Inflammatory religious commentary or misleading religious texts.
    • Dissemination of false information.
    • Content exploiting recent or current tragic events.

    Content Moderation System

  • Prior to creating or uploading content, users must accept our terms of use. Our content moderation system is tailored to the type of content hosted on ServEase. We provide in-app mechanisms for reporting and blocking objectionable content and users and take appropriate actions based on these reports.
  • 9. Content Backups

  • Although regular backups of Content are performed, we do not guarantee there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
  • We will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that we have no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
  • You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
  • 10. Copyright Policy

    Intellectual Property Infringement

    We respect the intellectual property rights of others. It is Our policy to respond to any claim that Content posted on Servease infringes a copyright or other intellectual property infringement of any person.

    If You are a copyright owner, or are authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement occurring through Servease, You must submit Your notice in writing to the attention of our copyright agent via email at support@servease.me and include in Your notice a detailed description of the alleged infringement.

    You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content on Servease is infringing Your copyright.

    DMCA Notice and DMCA Procedure for Copyright Infringement Claims

    You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing Our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

    • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
    • A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
    • Identification of the URL or other specific location on Servease where the material that You claim is infringing is located.
    • Your address, telephone number, and email address.
    • A statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
    • A statement by You, made under penalty of perjury, that the above information in Your notice is accurate and that You are the copyright owner or are authorized to act on the copyright owner's behalf.

    Upon receipt of a notification, We will take whatever action, in Our sole discretion, We deem appropriate, including the removal of the challenged content from Servease.

    Intellectual Property

  • The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of us and our licensors.
  • The Service is protected by copyright, trademark, and other laws of both Hungary and foreign countries.
  • Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of us.

  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

  • ServEase is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, we, on our own behalf and on behalf of our Affiliates and our and their respective licensors and service providers, expressly disclaim all warranties, whether express, implied, statutory, or otherwise, with respect to ServEase, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of the course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, we provide no warranty or undertaking and make no representation of any kind that ServEase will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free or that any errors or defects can or will be corrected.
  • Without limiting the foregoing, neither we nor any of our providers make any representation or warranty of any kind, express or implied: (i) as to the operation or availability of ServEase, or the information, content, and materials or products included thereon; (ii) that ServEase will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through ServEase; or (iv) that ServEase, its servers, the content, or emails sent from or on behalf of us are free of viruses, scripts, trojan horses, worms, malware, time bombs, or other harmful components.
  • Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

  • The laws of Hungary, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

  • If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting us.
  • For European Union (EU) Users

  • If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.
  • United States Legal Compliance

  • You must represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.
  • 18. Translation Interpretation

  • These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

  • Users are expected to conduct themselves in a professional and respectful manner while using ServEase.

  • We reserve the right to modify these Terms of Service at any time. It’s important to check the Terms of Service from time to time for any changes.
